1. Acceptance of Terms

By accessing or using Refundit (the “Service”), you agree to be bound by these Terms of Service (“Terms”), which form a binding agreement between you and ProxyGist, LLC, the owner and operator of the Refundit platform.

2. Service Description

Refundit provides users with strategic messaging and tools to help them independently pursue overdue or delayed refunds from third-party companies. We do not act as a legal representative, financial advisor, or intermediary between you and any company. You alone are responsible for sending the messages generated through our platform.

Refundit provides users with strategic messaging templates and tools to help them independently pursue overdue or delayed refunds. This includes optional modules such as:

Complaint Kit – A digital document generator that assists users in filing formal complaints with regulatory agencies (e.g. BBB, CFPB, State Attorney General).
Refund Contact Finder (RCF) – a search tool offering verified email addresses for escalation within major companies.

These tools are provided strictly for user-led action and are not a guarantee of outcome or refund.

Refundit services are intended for use by individuals located in the United States, pursuing refunds from U.S.-based companies or services operating within the U.S. We do not guarantee effectiveness or legal compliance in other jurisdictions.

3. Eligibility

By using the Service, you confirm that you are at least 18 years old and legally capable of entering binding agreements. You may not use Refundit on behalf of minors or individuals lacking legal capacity.

4. User Responsibilities

You agree to use Refundit solely for lawful and legitimate refund claims. You are solely responsible for:

The accuracy of the information you provide
Any communication you send using content generated through Refundit
Ensuring your use complies with any applicable laws or company terms
Not impersonating others or submitting fraudulent or malicious requests

You may not use Refundit to:

Impersonate any person, entity, or government body
Threaten, harass, or defame any third party
Submit false claims or deceptive information
Engage in any activity that violates fraud, impersonation, or consumer protection laws

Refundit reserves the right to suspend or terminate access at our sole discretion if we detect any misuse. We may report suspected illegal activity to the appropriate authorities.

You agree to use Refundit only in connection with legitimate refund claims tied to your real identity. Submitting false data or engaging in “test” abuse of our services is prohibited.

Users are prohibited from coordinating, organizing, or participating in mass campaigns targeting specific companies using Refundit templates. This includes responding to calls for coordinated action on social media, forums, or other platforms. Refundit reserves the right to investigate usage patterns and terminate accounts suspected of participating in organized campaigns that could damage our reputation or relationship with third parties.

5. No Guarantees or Legal Advice

Refundit provides templates, strategies, and informational tools. We do not guarantee outcomes, including but not limited to refund approvals, response times, or company compliance. Refundit is not a law firm and does not provide legal advice.

6. Ownership and License

All content, code, and tools provided via Refundit are the property of Refundit or its licensors. Users are granted a limited, non-transferable, non-exclusive license to use the tools for personal refund resolution purposes only.

You may not:

Copy, resell, or redistribute the templates or tools
Reverse engineer or attempt to replicate the system logic
Use Refundit outputs in commercial offerings without written consent

You may not use Refundit outputs to offer refund-related services to others without a commercial or enterprise license agreement. Unauthorized resale or redistribution is strictly prohibited.

Users may not systematically analyze, compare, or study multiple Refundit outputs for the purpose of extracting underlying methodologies, prompt structures, or AI training data. Submitting multiple similar requests to reverse-engineer our systems constitutes a material breach of these terms and may result in immediate termination and legal action.

7. Payments and Refunds

Access to certain features may require payment. By purchasing a service, you agree to the pricing and payment terms displayed at checkout.

Due to the digital nature of the service, Refundit purchases are non-refundable, except where required by law or in cases of technical failure that prevents delivery of the purchased product.

Filing payment disputes or chargebacks after successfully receiving and using our digital services may constitute fraud. We maintain records of service delivery and reserve the right to pursue collection, report fraudulent chargebacks to payment processors, and ban users who abuse payment systems. Users who file disputes in bad faith may be subject to collection efforts for the full amount plus administrative fees.

8. User Data and Privacy

By using Refundit, you agree to the collection and handling of your data as described in our Privacy Policy. You retain rights over your personal data, but grant us the right to store and process submitted information to fulfill our services and improve our platform.

9. Third-Party Content and Interactions

Refundit may include references to or interact with third-party services (e.g. companies you contact). We are not responsible for any third-party actions or content. We do not endorse or control any external companies and cannot guarantee their actions.

You acknowledge that any disputes, actions, or communications involving third parties (e.g. refund requests, complaints) are your sole responsibility.

10. Termination

We reserve the right to suspend or terminate access to the Service at our sole discretion if we believe you have violated these Terms or engaged in misuse.

11. Limitation of Liability

To the fullest extent permitted by law, Refundit shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, loss of data, or reputational harm arising from your use of the Service.

In no event shall our total liability exceed the amount paid by you for the Service in the past 12 months.

12. Indemnification

You agree to indemnify, defend, and hold harmless Refundit and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with your use of the Service, including any misuse or violations of these Terms.

You agree to indemnify Refundit from any claims, demands, or damages arising from content you send, including claims from companies, agencies, or individuals impacted by your use of our services.

13. Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted with an updated date. Continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in St. Louis County, Missouri.

You agree that any disputes with Refundit will be resolved through binding individual arbitration. You waive any right to a jury trial or to participate in class actions, consolidated claims, or representative proceedings. This arbitration agreement survives termination of your use of the Service.

15. Refund Contact Finder (RCF)

The Refund Contact Finder (RCF) tool provides verified corporate contact information to help users reach the appropriate escalation channels within a company.

By using the RCF, you agree:

You will not use the provided email addresses to send spam, threats, or bulk unsolicited messages.
You will not share, scrape, or resell RCF data.
You understand that these contacts are provided for individual consumer resolution purposes only.
Users attempting to bypass token restrictions or manipulate access through technical means may have their access revoked and accounts permanently banned.

We reserve the right to restrict access or block accounts for misuse, and we disclaim all liability for any results, outcomes, or communications that occur after you contact third-party recipients using RCF data.

Systematic attempts to extract, map, or harvest our contact database through repeated searches, automated tools, or coordinated account creation are strictly prohibited. We employ monitoring systems to detect suspicious usage patterns, and users found harvesting data may face immediate account termination and legal action for theft of proprietary business information.

16. Complaint Kit Usage

The Complaint Kit is intended to support users in filing truthful, accurate, and legally permissible complaints with relevant consumer protection bodies. By using the Complaint Kit, you agree that:

You are solely responsible for the content of any formal complaint you submit.
You will not use the Complaint Kit to submit fraudulent, exaggerated, or malicious claims.
Refundit does not file complaints on your behalf and cannot be held responsible for the actions of regulatory agencies or the responses of the companies involved.

Any abuse or misuse of these templates may result in immediate termination of access to Refundit services and possible legal action.

Refundit is not a third-party representative or proxy for any regulatory complaint and does not transmit, submit, or forward complaints on your behalf. All filing is your responsibility alone.

17. International Use

Refundit is operated from the United States and intended solely for use by individuals located in the U.S. If you access or use the Service from outside the U.S., you do so at your own risk and are responsible for compliance with local laws.

We make no representations that Refundit, its content, or associated services are appropriate or available for use in other countries.

18. AI/Automated Content Disclaimer

Refundit utilizes artificial intelligence to generate refund strategy messages, complaint templates, and escalation content based on user inputs. While we strive to ensure the accuracy and professionalism of all AI-generated outputs, the nature of automated content generation means results may vary and may include unintended inaccuracies, tone mismatches, or incomplete phrasing.

You acknowledge and agree that:

You are solely responsible for reviewing and approving all AI-generated content before using or sending it
Refundit disclaims all liability for outcomes resulting from AI-generated content, including but not limited to reputational damage, delivery issues, or ineffective claims
AI outputs are not legal advice, guarantees, or verified factual claims
All content generated via Refundit is a reflection of your own inputs. You understand that Refundit is not the author of any message or claim you choose to send, and you assume full authorship of any messages you copy and use.

19. Platform/Email Provider Compliance

You acknowledge and agree that:

You are solely responsible for reviewing and approving all AI-generated content before using or sending it
Refundit disclaims all liability for outcomes resulting from AI-generated content, including but not limited to reputational damage, delivery issues, or ineffective claims
AI outputs are not legal advice, guarantees, or verified factual claims

20. Regulatory Filing Accuracy

If you use Refundit's Complaint Kit to file with regulatory bodies (e.g., BBB, CFPB, or a State Attorney General), you agree that:

You warrant that all submitted information is accurate, truthful, and based on your personal experience
You understand that filing false or misleading complaints may constitute fraud and could result in legal consequences
You indemnify Refundit against any liability, investigation, or damages arising from your misuse of the Complaint Kit
Refundit provides templates for user-driven action only and does not file complaints on your behalf

21. Success Rate Disclaimers

Any references on our website, platform, or service to refund success rates, outcome likelihoods, turnaround times, or company behavior are purely illustrative. They are based on anecdotal data, historical user reports, or sample cases and do not reflect real-time outcomes.

By using Refundit, you acknowledge that:

No outcome is guaranteed for any case, regardless of company, refund type, or template used
Outcomes may vary significantly depending on timing, tone, company responsiveness, and other external factors
You should not rely on past results as an assurance of future performance

22. Corporate Response Variations

Refundit templates are designed to be effective under typical refund delay scenarios. However, each company may respond differently, and corporate policies may change without notice.

You agree and understand that:

Companies may alter their internal escalation or refund procedures at any time
Some may respond less favorably to repeated messaging or escalate their own internal actions (e.g., account suspension)
We do not guarantee that any specific refund, complaint, or pressure strategy will remain effective over time

We are not responsible for any adverse action taken by third parties in response to your use of our messages, including but not limited to account suspensions, bans, or service denials.

23. Volume/Frequency Limitations

To ensure fair usage and prevent abuse of our platform, Refundit reserves the right to limit account activity based on total volume, usage patterns, or behavior that appears excessive or automated.

Specifically:

Users are limited to a reasonable number of message or tool requests per month; paid tiers may offer higher caps
Use of bots, scripts, or automated tools to access Refundit or the Refund Contact Finder (RCF) is strictly prohibited
Commercial or agency use (e.g., on behalf of multiple users or clients) requires a separate enterprise license
We may restrict access or revoke service for any user violating these limitations

24. Content Monitoring and Moderation

While Refundit does not actively monitor every user submission, we reserve the right to review content, investigate patterns, and enforce policies when misuse is detected.

You agree that we may:

Refuse to generate or deliver content that violates these Terms or appears abusive, harassing, or unlawful
Modify or restrict access for any account suspected of generating fraudulent, inappropriate, or misleading requests
Report suspected violations or fraudulent activity to relevant authorities or platforms when necessary

25. Third-Party Integration Disclaimers

Refundit integrates with external services such as Supabase (data storage), Stripe (payment), Resend (email delivery), and others to perform core platform functions.

By using the Service, you agree that:

Refundit is not liable for outages, data breaches, or limitations caused by any third-party platform
Any changes to APIs, rate limits, or availability from third-party providers may impact Refundit's functionality
You are subject to the terms of service of those external services when applicable
Refundit disclaims all responsibility for the privacy, accuracy, or performance of services outside our direct control

26. Dispute Independence

You acknowledge that Refundit is not a party to any dispute between you and any company, platform, or regulatory body. We do not mediate, investigate, or intervene in such matters, and we will not provide testimony, documents, or third-party engagement support without a court-ordered subpoena.

27. No Legal Representation

Refundit is not a law firm, consumer agency, or refund intermediary. We do not provide legal advice, representation, or guaranteed outcomes. Use of our tools does not establish a client relationship with Refundit or any of its agents.

28. Accessibility and Limitations

Refundit is designed for general access and does not currently offer disability-specific accommodations, screen reader optimization, or multilingual support. By using the service, you acknowledge these limitations.

29. Anti-Coordination Clause

Users may not coordinate with others to simultaneously target companies using Refundit templates. Mass campaigns, organized efforts, or group actions that could associate Refundit with harassment campaigns are prohibited.

30. Competitive Intelligence Protection

Users may not access Refundit for the purpose of competitive analysis, template extraction, or building competing services. This includes systematic testing to reverse-engineer our methodologies.

31. Regulatory Immunity

Users acknowledge that filing complaints against Refundit with regulatory bodies based on normal service usage constitutes misuse of regulatory systems and may violate anti-SLAPP statutes.

Users agree that filing complaints against Refundit with regulatory bodies, consumer protection agencies, or legal authorities based solely on disagreement with our terms, pricing, or normal service delivery constitutes abuse of regulatory processes and may subject the user to liability for costs and fees associated with responding to frivolous complaints.

32. Monitoring and Abuse Detection

Refundit employs automated and manual monitoring systems to detect fraudulent usage patterns, including but not limited to:

Repeated similar submissions
Suspicious payment patterns
Coordinated account behavior
Systematic data extraction attempts

Users consent to this monitoring as a condition of service use.

33. Force Majeure

Refundit is not liable for service interruptions caused by events beyond our reasonable control, including but not limited to: third-party API changes, payment processor outages, cyber attacks, natural disasters, or government actions.

34. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

35. Your Data Rights (GDPR / CCPA / CPRA)

Depending on your location, you may have additional data rights under laws such as the General Data Protection Regulation (GDPR) or the California Consumer Privacy Act (CCPA/CPRA). If these laws apply to you, you may have the right to:

Request access to the personal data we hold about you
Request correction or deletion of your personal data
Object to or restrict certain types of data processing
Request a copy of your data in portable format
Opt out of the sale or sharing of personal data (where applicable)

Refundit does not sell personal data to third parties. We collect only the data necessary to provide and improve our services, and we retain that data only as long as necessary for operational, legal, or regulatory purposes.
